Separation pay may be computed based on the terms provided in the employment contract, company policy, or collective bargaining agreement. Company practice may likewise be used as basis for computation, if such practice has been established for years and has already ripened into a demandable right.

In the absence of contract or agreement, or when the existing agreement or policy provides for a lower benefit, separation pay shall be computed based on the provision of the Labor Code.

The amount of separation pay under the Labor Code depends on the following factors:

  1. The employee’s last salary;
  2. The employee’s length of service;
  3. The reason for employee’s separation from service.

Employee’s last salary

The employee’s last salary refers to the salary rate of the employee at the time of his termination from service. It determines the based to be used in the computation of separation pay.

When there is a reduction of the employee’s salary prior to his termination, e.g., the employee has been demoted resulting to a reduction of salary, such reduced salary rate, which is his ‘last salary’ shall be the basis of the computation. But, if the reduction of salary was made to circumvent the provision of the Labor Code, that is, to avoid payment of higher separation pay, the salary rate before the reduction shall be used in the computation of separation pay.

For employee’s receiving salary below the minimum wage, the separation pay shall be computed based on the minimum wage in effect at the time of separation from service. In addition, the employee affected is also entitled to payment of salary differential equivalent to the difference between the employees actual salary and applicable minimum wage.

Employee’s length of service

Employee’s length of service refers to the duration of time that the employee has been under the employ of the same employer or company. It is computed beginning from the time of his engagement up to the date of his termination. A fraction of at least 6 months shall be considered as one whole year.

However, only the employee’s last continuous years of service should be considered in the computation (See Carandang vs. Dulay; Also Sta. Catalina College vs. NLRC; Phil. Tobacco Flue-Curing vs. NLRC.)

The reason for the employee’s separation from service

The reason for the employee’s separation from service is an important factor in the computation of separation pay. The amount of separation pay may vary depending on the specific ground relied upon for the termination.

An employee terminated based on installation of labor-saving devices or redundancy is entitled to at least one-month salary or to at least one-month salary for every year of service, whichever is higher. (See Article 283, Labor Code)

For termination based on retrenchment to prevent losses and closure of business, the employee affected is entitled to at least one month salary or 1/2 month salary for every year of service, whichever is higher. (Ibid.)

An employee terminated for health reasons (disease) under Article 284 should be paid separation pay equivalent to at least one-month salary or to at least one-month salary for every year of service, whichever is higher.

In case of illegal termination, separation pay in lieu of reinstatement has been consistently computed at one month salary for every year of service.

“At least one month or 1/2 month for every year of service?”

The phrase “at least one month salary or 1/2 month salary for every year of service, whichever is higher”, can be quite confusing. See these comments: Comment 1, Comment 2. The phrase though is not really complicated. It simply means that the employee is entitled whichever is higher of the employee’s:

  1. one month salary; or
  2. 1/2 month salary for every year of service.

Example: If the retrenched employee’s salary is P8,000, and he has been working for 3 years, he is entitled to separation pay equivalent to whichever is higher of his:

  1. one month salary = P8,000; or
  2. 1/2 month salary for every year of service = (1/2) x P8,000 x 3 years = P12,000.

In the above example, the employee is entitled to P12,000, the higher amount.

Following the same rule, if the length of service is only one year, his separation would be whichever is higher of the following:

  1. one month salary = P8,000; or
  2. 1/2 month salary for every year of service = (1/2) x P8,000 x 1 year = P4,000.

Here, separation pay is P8,000 or one month salary, the higher amount. Actually, we will arrive at the same result even if the length of service is only 10 months or 7 1/2 months, etc., as long as it is 6 months or more. This is because a fraction of at least 6-months is considered as 1 whole year.

Now, what if the employee has served for less than 6 months, how much separation pay will he get? Let’s see.

  1. one month salary = P8,000; or
  2. 1/2 month salary for every year of service = (1/2) x P8,000 x 0 year = 0.

So, it’s still P8,000 or one month salary.

Minimum Separation Pay

Take a quick look at the examples given above. You will notice that the minimum separation pay that may be given to an employee is one month salary. This is actually consistent with the phrase “at least one month salary”, which simply means that the separation must not be less than the employee’s one month salary.

    Separation pay for retrenchment, redundancy and similar causes beyond the control of employee is tax-exempt.

    Section 32[B][6][b] of the National Internal Revenue Code states that “Any amount received by an xxx employee xxx from the employer as a consequence of separation xxx from the service xxx because of death sickness or other physical disability or for any cause beyond the control of the said xxx employee” is exempt from tax.

    Makukuha mo ang iyong unpaid salary, proportionate 13th month pay, cash equivalent of unused SIL credits, at iba pag benepisyo na hindi pa nababayaran ng company. Bukod dito, maari mo ring makuha ang anumang benepisyo na nakasaad sa iyong employment contract, o CBA, kung meron man.

  7. Hi, I just want to ask. I will be separated from work on Oct 16. When can I get my separation pay? Is it legal if I will be waiting for 60 days? Because I was able to see in the Labor Code that separation is being given to help the employee in finding a new job.   8. Sa mga nagtatanong about separation pay, lilinawin lang namin na kapag ang employer nyo ang nagterminate sa employment nyo, pede kayong makakuha ng separation pay or depende sa CBA nyo kung may union kayo.

    Sa mga VOLUNTARY RESIGNATION naman eh kahit na gaano kayo katagal pa sa kumpanya eh wala kayong makukuhang separation pay depende na kung may CBA kayo. Magkaiba po ang separation pay sa final pay. Kung voluntary resignation ka at walang CBA eh final pay lang makukuha mo, ayun ang iyong hindi pa nakukuha na sweldo, conversion ng earned SL or VL ( kung meron nito), proportionate 13th month pay at kung meron pang ibang benepisyo na hindi naibibigay ( depende rin sa company rules).     Just want to ask how can I go with this. I was charge by my staff of an offense that are not actually true however, since I am a manager i was asked to resign if i would not allow myself to be implicated and sanctioned a 30 days suspension. In other words, I took the challenged. However when I asked how much will i get then accdg to the company i will not receive anything. Im with the company for 5 years and 2 months. I have an earned credits 0f 21 sick leave, 14 vacation leaves and 2 emergency leaves. Accdg to the HR, there is no separation benefits and leaves are not convertible to cash.   22. Good Day! I would like to brought this issue regarding on the separation pay policy of our company. They had issued a new policy this January 2012 and had brought to our attention that “all employees that are regularized year 2005 below are eligible for a separation pay, and employees that are regularized January 2006 and after are not eligible for a separation pay” in which in my case who was regularized by June 2006 IS NOT ELIGIBLE for a separation pay, just incase I’m planning to resign with a minimum 6 years of service in the company. May I ask if this policy of our company should be brought up to the Philippine Labor law?

    Assuming your termination is legal, you are entitled to separation pay. The amount you are entitled to receive depends on the reason for your termination, which should have been fully explained to you. If they just say that you are being terminated “for reduction of employee”, that’s definitely not enough.

    Generally, separation pay in not taxable because it is not considered income. Under Sec. 32 (B)(6)(b), Tax Code, “Any amount received by an official or employee or by his heirs from the employer as a consequence of separation of such official or employee from the service of the employer because of death sickness or other physical disability or for any cause beyond the control of the said official or employee.”
    The key here is, the reason for separation must be beyond the control of the employee.

    Im working in a call center and our account will be closed by August. As per meeting with the HR team, we heard that we will be given 1/2 of our monthly salary. Isn’t it unfair for us? If i were to follow the computation posted, my salary of around 15k (1/2) of it is 7500 x 4 years = 30,000. Whereas if they will give the full salary x 4 years = 60,000. If we are talking about whichever is higher, would the last computation be the separation pay? Please clarify. Thanks.

    1 month means 1 month, not a month per year of service. In short, its the minimum separation pay an employee can get.

    1 month of pay

    OR

    1/2 month x Years of service

    whichever is higher.

If an employee who resigned after 4years+ of service,and during the last term, her employer promised that regular employees will be given a guaranteed 14th & 15th month pay if the company achieve the target sales before the year ends. And so target sales was indeed achieved and by December2011 the 14th month has been paid to the employees, while the 15th month pay shall be given in May2012 of the following year. My friend work for this Insurance company as a Project Employee for almost a Year specifically 1 year and 3 months and he decided to resign for the reason that he expect that he will work for 6 months probationary and be a regular employee after, Unfortunately, 1 year passed and still no work progress and development he even don’t know that his Job is as Project employee. And the day he filed his resignation dated June 21 and the resignation’s effectivity will be after 30 days so he worked for a month got his salary in the 15th month of July. Have still 5 days to work for the said company and quit the Job. He’s expecting to have his salary for that 5 days of service, but upon checking his account unexpectedly he didn’t have his salary. What will be our next plan of action for this? Addition to that, is a Project employee required to have his separation pay?thank you and God Bless

I asked my ex-colleagues to check the status of my clearance because it is “online” but accessible only through intranet. My ex-colleague told me that the status of my clearance is still open/pending for approvals. I tried contacting the HR person who will approve it but having a hard time contacting her. Phone and email they do not reply. They keep on telling me to call again. Its been more than a month and my clearance is still pending and I cannot get my last pay. Any suggestion?

    i worked as a project based employee for more than seven years in my previous company. our company already ended our contract last July 21 due to closure this coming aug 31. the account has been pulled out. there were other agents left and will get their severance pay based on their salary times the length of stay plus other benefits but for us who ended last july 21, we will only get the pro-rated 13th month pay, remaining salary, SL/VL pay and tax refund (if applicable to us). are we really supposed to get only that? even if we are more than 5years working in the company?

    Ako po ay Operations Manager ng isang crewing agency dito sa manila ako po dati ay nagtrabaho mula pa noong 1992 at noong pong 2001 tinangal nila ako by cause? Dahil masyadong maraming problema at kung anoano mga negative issues laban sa akin ng kapatid ng asawa ng boss ko sila ay nag padala ng sulat sa poea na ako ay pinapalitan na ng kapatid ng asawa ng boss ko. Ano po ba ang dapat kung gawin at matangap na binipisyo para sa aking at ako ay aalis na laman ng maayos at walang problema sa kanila?
    Minsan ako ay sinabihan noong bigyan niya ako ng 2 taong separations pay? ibig sabihin po noong 13,000 x 24 mos. = P312,000.00 pesos ang aking matatangap?

    Just want to ask, the procedure, how to file a complaint for a company, I just recently resigned from Modern Imaging solutions, I already processed my clearance and I’m already cleared. I was asked to claim my backpay, until they accessed my mail, which contains all of my accounts with them that I have acquired during my stay, I used that up until my last week with them, hoping to still give them revenue. After I was cleared, I applied in a competitor which they hate the most. They used that against me and made that a reason to put my backpay oh-hold, I went to them and spoke with the General Manager, and That rude foreigner just went very unprofessional telling it to my face that “NO WE WON’T GIVE IT TO YOU”.
    We found out that you’re working for our competitor and such, I told them that it’s illegal and they don’t have the right to do that, He called me a loser, which I perfectly fit with their competitor, I never signed any non-compete, and even if so, it is still not right to put it on hold. He said that they’re gonna sue me, and I told him that I would also make necessary actions about this. I would like to ask assistance about my case.

Nag-work ako sa isang IT company as an account manager and meron account ako na na-handle na hindi pa nagbabayad sa isang Purchase nila. Nag-resign na ako and na-turn-over ko na lahat ng documents sa immediate supervisor and replacement ko. Ngayun ayaw nila ako i-clear ksi daw hindi pa bayad yung customer. Gusto ko lang i-clarify if tama ba ang ginagawa nila na aantayin pa magbayad ang customer before nila i-process ang clearance ko and i-bigay sa akin ang last pay, 2316, COE, etc.

  86. Makakatanggap po ba kami ng separation pay kasi ang contract po namin ay para po sa one year Fixed Term Contract. Ayon po kasi sa Labor Code basta nakapagemployed ng 6months to 1 year ay may makukuhang separation pay. Pero ayon naman sa aming employer hindi kami entitled makakuha ng separation pay kasi naka-fixed term daw po ang aming contract. Kami po ay nasa power plant at hindi naman ito project contract.     So confusing lng po kung paano b tlaga yung computationg ng separation pay makukuha ko. Halimbawa yung length of service ko ay 2 years and 5 months.. According to law ang 6months length of service is considered 1yr. In my case 2yrs and 5mons ung length of service ko. So it means ung excess n 5mons is not included to the computation. 1mons. Salary or 1/2 mons. X 2years lng makukuha ko? Please enlighten me w/ this scenario. Salamat po

    sir I read basic details and comments regarding separation pay in this site.Please tell me if tama bang sabihin ng private company namin na “i-compute ang seperatin pay starting ng regularity contract plus 5VL lang and di kasama ang SL.” kasi po nitong Jan 14, nag turn over na po para sa new owner ng company.I understand all the proper reason of separation computation. pero di ko parin maintindihan bakit di kasama ang probationary period ko, dapat ba nakasaad pa yun sa contrata, pati po 5SL. please enlightened me bec. our compony always says that they fallow only what’s in the labor code.

That means, I am employed for 12 years and 4 months.My reason for resignation is to give time for my family and we’re planning to migrate. Is that a valid reason? Can I still avail of separation pay?     magresign po ako sa company namin private company po sya tinatanong ko yung back pay ko kung may makukuha ako ang sabi sakin yung isang buwan ko ng sahod yun yng back pay ko sumasahod ako sa isang buwan ng 18k pero yung back pay ko yun yung bayad sakin ng isang buwan na sahod na pinapasukan ko pa sakanila.. saka po yung sick leave po ba makukuha ko din po ba yung hindi ko pa nagamit?

  104. sa lahat ng nakakabasa please patulong naman sa may mga alam dyan…salamat po. service crew po ako at ang backpay ko po sa agency na pinagtrabahuan ko before until now di ko pa po nakukuha.two years po ako na hawak ng agency tapos june 2012 po pinaresign kami sa kanila.after two to three months daw po makukuha ang backpay namin.so tumawag po ako sa office ng agency by september 2012…processing pa daw ang sa akin kasi daw sept.5 daw nila nareceive yong clearnce.ang sabi follow up na lang daw ulit two to three months.december 5 nag follow up po ako…wala pa daw.next thursday follow up ulit ako.natuwa ako po kasi my sched na decmber 21 makukuha ko na backpay ko…kasi po magpapasko na.so pagdating ng december 20 tinawagan ko to confirm talaga bout my backpay….sabi ng president ng agency…sa 28 na lang daw.my o my….pagdating ng 28 tinatawagan ko po di sila sumasagot nor nagrereply sa text ko.hanggang ngayon di ko pa po nakukuha.salbahe sila na agency.sana may tumulong sa akin para mapasara sila.mahirap lang din po ako at malaking bagay din po ang backpay na un.

  105. good evening sir/mam, i need some clarifications. im working at a restobar for almost 8 years, ( 7 years and 7 months ) and only receiving 235 a night, no night premiums, but benefits has been given to us employees. our bar is currently renting at a functional building for conventions and etc. now it comes to an end since the new owner of the building has plans to build a hotel and since we are currently renting in it. we’ve been force close. the owners in our bar agreed to pay us everything but recently rumors has came out that we only get 20k+ for the whole 8 years. its really unfair if we only get that much. i’d like to ask if what will be the right computation for it.

    nagterminate po kami ( just cause = behavioral problems) ng empleyado at dinala nya yung concern sa NLRC. mga 7 months pa lang po sya nagwork sa kumpanya. kumpleto po kami ng mga dokumento na nagpapatunay na hindi na dapat syang manatili sa kumpanya. maliit lang ito at first time lang talaga itong nangyari sa amin. nasa due process po naman ung pagterminate namin pero ang sabi po sa amin sa NLRC at nang lawyer na medyo may sobrang liit na pagkukulang kami na step sa pagterminate, ito ay ang letter coming from the company asking the employee to explain or a letter to explain, pero po nasabihan naman po namin syang magexplain verbally nga lang po at nagsulat naman sya, nung hindi kami satisfied, tinerminate namin sya after few days at nawarningan na rin po namin sya na magdedesisyon na ang kumpanya noong linggong iyon.

    August 2004 i was hired as a reliever (3 days a week)with no contract for 7 months, after that i signed a contract for probationary period for 5 months, after i signed as a regular employee until this year 2013. my question is, can the 7 months with no contract be counted for the computation of the separation pay.

    what if po kung ung employer and other higher ups just gave us a notice na magcoclose na un company nmin the day after.. they just told us last feb 12 2013 11pm..at bukas ay wla ng pasok dahil nagsara na ang company.. i think it’s unfair for us because it should be a 30 days period of notice before maging effective un pagsasara ng company.. if ever po ba, may mahahabol kami sa company nmin na for any damages or any extra pay, dahil hnd cla nag follow ng proper procedure in giving notice to the employees.. it’s like we’re riding in a sinking ship na sa isang iglap wla na kami work kinabukasan..

    also another issue is ung sa nakalagay sa clearance form ay we are voluntairly resigned from our company.. tama po ba na nakalagay un ? na ung totoo nman ay we were retrenched from the company.. that’s why hindi ko pa pinipirmahan un binigay nilang clearance form at wla pa ko nakukuhang last pay..the last pay includes only the unused SIL, pro rated 13th month pay, income tax return (if there’s any), last 7 days na pinasok nmin at 1/2 of the month’s salary for every 1 year of service…

    Wala po kayo makukuha separation pay kasi po hindi naman po kayo tinanggal sa trabaho, kusa po kayong nag-resign.
    Depende na po kung nasa company policy ng EVY construction na nagbibigay sila “Gratuity pay” bilang pasasalamt sa tagal at haba ng serbisyong binigay ng empleyado. Pero kung wala po sa company policy yung “gratuity pay” hindi po natin mapipilit ang employer kung kusa naman po kayong nag-resign.

    Ang istorya ko po ay ganito. Naaksidente po ako (head injury) nung jan. 29, 2013 after ko po umattend ng 1 business meeting. Pinaalam ko po sa employer ko, nagsabi po sya na sasagutin po lahat ng magagastos ko sa ospital. Nagbigay po sila ng Php15000.00 paunang pang-gastos. Nagpalipat po ako ng ospital kasi wala po maibigay ang ospital na attending physician (neuro surgeon). Naubos po yung unang bigay ng employer ko. Sarili ko na po ang gumastos sa nilipatan kong ospital hanggang sa makalabas po ako. Advice po saken nung doctor ko na magrest ako ng 2 weeks. After po ng 2 weeks nagreport po ako sa employer ko. Sumama po yung loob ko after po nung Php15000.00 wala na po silang pakialam sa aken kaya po after 5 days nung magreport po ako nagfile na po ako ng resignation ko. Kung sa ganitong set-up po ba may marereceive po ba akong separation pay? 8 years po ako nagserve sa employer ko. Salamat po.

    hope you can enlighten me more, medyo me gray area po para sa isang layman na katulad ko yung length of service.

    “A fraction of at least 6 months shall be considered as one whole year”, pano po yung below 6 months? na ro round off din ba yun pababa? for example 5 yrs and 3 months ang tenure, rounded ba sya to 5 yrs lang or di na ni roround off pag less than 6 months, which would mean 5.25 yung yrs sa gagamitin sa multiplier?

    isa pa po if me cba pero di natackle yung rounding off ng yrs of service will this rule still follow?

    hi! i’ve been working for a salon for 8 years now. last month, the owner sold the salon and next month (May, 2013), i am one of the few employees who are “absorbed” by the new owner of this salon.

    the previous owner gave me separation pay but she only started the computation from january of this year (2013) until april, 2013. hindi po ba dapat ng-start ung computation ng year 2005? ano po ba ang dapat according to the law?

    one more thing, i asked the previous owner for a Certificate of Employment pero sabi niya ay hindi daw siya ng-iisue ng ganon. hndi na daw po kylangan un dahil kukunin nman na daw po ako ng bagong owner ng salon. tama din po ba ung reason nya?

My salary just increased after 2 years of working with the org but the increase according to them is in a form of allowance. After realizing that the basis of computation of my separation pay does not include the allowance, I was surprised even the computation of my 13th month pay, unlike before that my 13th month pay is inclusive of the allowance.     i was resigned last January 15 2013, our cut off date is January 10 2013 and payroll day po namin is 15th and 30th of the month.     Ask lang po ako, im reservationist of resort accommodation.Okey lang po ba na icharge nila sa akin yong naging utang ng travel agency sa amin. sinasabi po nilang dahil daw po sa kapabayaan namin. maliban po sa salary namin per day,share sa sss and philhealth benefits. wala na po silang incentive na binbgay sa amin. okey lang po ba yon na icharge nila sa amin ang buong amount. kahit na wala po kaming signed contract simula ng maemployed kami. and then pinagawan kami ng memo to pay the total amount ng agency na nagkautang sa amin.   135. I have similar problem in that I was asked to move to a far location (i.e. Cagayan de Oro from Manila) right away. Do I have the right to ask for some time (say 1 month) to settle my affairs in my present location first ? When I initially asked for 2 weeks, I was told it was urgent and I needed to go. When I offered to go first and take care of urgent matters there and then come back temporarily to settle my affairs here, I was told it is okay but this would be deducted from my benefits (i.e. airfare, time, etc.) What is my right under the law ?

    Then, the management transfer the whole work force to another company name(different company name, same nature of business, same management). Our employment date was reset to January 2008 as reported to BIR, resetting also our sick leave benefits. Should we receive also a separation pay given this condition?

    May question po ako..ito po ay tungkol sa case ng asawa ko..they were terminated dahil sa ang kaso daw po nila eh nagpapalaba sila ng hotel uniform nila sa laundry section…immediately they were suspended for a month (first offense)..regardless of the explanation letter…now they file a case in DOLE…4 years po nagwork ang asawa ko don..ngaun d na daw po sila pede bumalik at may pinadala sa kanila na sulat (though wala pa kami natatanggap) stating na totally daw eh terminated na sila sa hotel..ngaun hindi daw po pedeng ikaso don eh illegal termination? at the same time during the whole time na nagwork sila don wala sila contribution ng SSS.     I have a couple of questions and i wish to get an answer please soonest. My husband works in a hotel He started working May 3, 2009 and he resigned in Oct. 15, 2009 then was re-hired in March 16, 2010 and was illegally suspended in May 20, 2013…I say illegally since on that day they were not allowed by the security on duty to enter the hotel premis. He was telling that there was a suspension letter signed by the hotel manager yet they were not given a copy. The case was, they were suspended on the grounds of having their hotel uniforms and inner shirts left at the laundry section for washing (imagine that)no notice was given to explain their side instead they were suspended immediately for a period of one month…Is that legal attorney? Further more, during those times that he worked for that hotel (almost 4 yrs) they never received a holiday pay, they were compensated below minimum wage, he never had any SL/VL credit (no work/no pay), under paid on 13th month pay, and the most they never reported/remitted a single contribution for SSS, PHIC & HDMF (which i understand shall be mandatory regardless of the nature of employment..correct me please if i am wrong). To add, they were never given a proportionate share for the service charges they collect from their hotel clients. They said that only those belonging under a managerial position is entitled for that share. Is that true? As i read the labor code manual it says that 85% of the collected service charge shall be divided equally to rank and file employees and 15% shall be for the management. Did i read it correct attorney? And my husband works as a housekeeping supervisor for that hotel…The thing is they do not issue payslip, they don’t even have ID’s…What can he do to claim all of these? Please…please help us…The hotel is manned by 40+ employees..The owner is influencial…and now they said that they have already sent my husband a letter telling that he is officially terminated due to that laundry thing…and they said that it was an act of theft????? My god please what shall we do? It will be very much appreciated if you could give us tidbits of advice…Thank you very much!

  152. Just received my retrenchment notice the other day. According to the notice they will give me a separation pay, but they verbally explained it to me na 1/2 month salary daw po un for every year of service plus COLA, remaining 13th month, including my SL and VL.. We also have our RATA kasi.. DApat po ba included din yung RATA? May nabasa po kasi ako sa Labor code:

    Inclusion of Regular Allowance in the Computation
    In the computation of separation pay, it would be error not to
    integrate the allowance with the basic salary. The salary base
    properly used in computing the separation pay should include not
    just the basic salary but also the regular allowances that an
    employee has been receiving.g

    Ano naman po ang effect ng retrenchment sa paghahanap ng bagong work? kasi sabi sa amin mg file na lng daw ng resignation kesa retrenchment para di bad record. Tama po ba yun.

Been with this company for 11 years, me and my fellow Head of Department (let’s call her Shaina) were trained last May but only one will be promoted. i know i had the edge over her if skills are concerned coz i’ve been the assistant of the one in position (Erich) for the longest time. The catch is, they are blood-related, cousins. and worst, Shaina’s assistant (which will be promoted as well if she got promoted) is Erich’s husband. Shaina got promoted, though.     Hindi entitled sa separation pay ang empleyado na nag resign, maliban nalang kung may company policy na nagbibigay sa empleyado ng karapatan na makakuha ng separation pay.

    Ang minimum na separation pay ay equivalent sa one month salary. Ibig sabihin kahit less than one year ka, entitled ka sa one month. Kaya lang hindi mo nabanggit ang dahilan ng separation mo. Nakabase din kasi sa dahilan ng separation ang amount ng separation pay.

  172. Good evening, I resigned from my previous company and I am supposed to get my final pay, COE, ITR which they scheduled on September 23,2013. However, the release day of Final Pay and ITR is every Friday only, so I went there Friday, September 27,2013. But I was unfortunate to get anything since the Company’s Payroll Personnel went ‘undertime’ that day but the front desk personnel (which are the Security Guards of the company) was able to show me the list of the names of resigned employees which already have available final pay (back pay), ITR and COE. He gave me a number to call to follow up for my ‘final business’ with them, but when I called yesterday and earlier today, its still the same reason from the front desk personnel na ‘HINDI PA DIN DAW AVAILABLE YUNG PAYROLL PERSONNEL NILA’. My question po is, is there a Department po ba where I can report this issue and ask help so I can get my final pay check, ITR and COE? Kailangan ko din po kasi yung ITR and COE for my new company, at syempre po, kailangan ko din yung final pay ko dahil karapatan ko na makuha ang pera ko di po ba?     Good Day! Our company will close end of December 2013 and we have separation pay stated on our House Rule.
    The reason for the closure was not due to serious losses or financial reverses. I just want to clarify if the regular allowance is included and added to the basic pay in the computation of the separation pay as stated in DOLE Statutory monetary benefit handbook.(Chapter 13, letter E on Separation Pay).

    That’s correct. Regular allowances, which form part of the wages of the employee (e.g. fair and reasonable value of board, lodging, and other facilities), should be included in the computation. Other allowances of more or less temporary or conditional in nature (not regular) are not included in the computation.

  178. hi, ask ko lang, may balak kasi ako magresign by november 18. almost 7 hrs na rin ako sa company namin, call center company. sabi ng HR nmin after 45 calendars day mkukuha ung back pay, so technically by the end of december or early january ko pa sya mkkuha. meron po ba sa phillipine law na dapat maibigay ung back pay pay bago mag-chrismas? na hindi na ssundin ung 45 calendar days? ask ko lng, kasi prang sabi ng friend ko, mandated daw yon.     Good day. I worked in a call center company for a year then I voluntary resigned due of my health condition. As their protocol I call them kung ready na yung check the finance department said YES and it’s ready to release. I went to the office then they informed me na ihohold daw nila yung check kasi me pending loan pa ako sa SSS. As per SSS daw ibibigay sa kanila yung amount ng back pay ko. Tama po ba procedure ng company na yun?

  204. maliit lng po ang aking nakuhang back pay s previous ko pong employer. ang kasali dun and ang 13 month pay, unused leave credits and and the last pay pero my deduction for taxes and contribution for sss and pag-ibig. deducted din sa sss loan so i only got php 4,415. ganun lang po ba kalaki ungdapat kungmakukuha kasi based on what in i have read above inlcuded yung length of service.

    I started training with my (call center)company October 7, 2013, I was endorsed to EMBED December 2013 and been endorsed to operations eventually. December the Call center’s client decided to pull out the account and announced that the account will stay with the company till the 30th of January 2014. We were advised that we will receive severance pay. At first we were told that even if we only serve the company for 4 months (on January 31, 2014) we will receive our severance pay equivalent to one month salary. Now comes the 13th of January there was an announcement that the severance pay will be based on the lenght of service (pro-rated). For us this is completely unfair. After makin us sign a letter that says we accept the severance pay in leiu of the lateral entry to another process (they did not really gave us a choice), here come a news thats really inconsiderate. Is this legal? Please help.

    Wala pong separation pay ang empleyado na nagresign, maliban nalang kung nakasaad ito sa employment contract, o di kaya ay nakagawian na ng kumpanya na mag bigay ng separation pay sa nag resign na empleyado.

    Ganun din ang empleyado na natanggal dahil sa negligence, wala ring separation pay.

    I ended my contract last year. the last working date was Dec. 22, 2013. our payday was 15th and 30th. 30th pay day covers 1st to 15th working. therefore I still received my Dec. 1 to 15th pay last Dec. 27.

    I filed my clearance last Jan. 8 and waited for more than 60 days. I got my last pay, 2316, and COE last March 12. Now, for 2 yrs and 5 mos of working in the company, I only got 4k only. It’s a BPO company. All the employees their are contractual. As I checked the payslip for the last pay, the calculation was just purely the remaining days that I worked till the EOC date.

    Everyone was shocked because of my last pay. I want to make sure about this. I was really depressed of my last pay because I thought I will be receiving a big amount because of the work length and my package is big.

    I can’t even complain when I got my last pay because they had not allowed me to go inside the company but had me waited outside and only the guard was coming in and out the accounting office.

    If we based it on the Labor Code, there is no separation pay when the cause of termination is the end of contract. So unless your employment contract or other agreement states that you are entitled to separation pay, their computation may be right. Don’t take this as a legal advice though, as always, it is best to consult your lawyer.

  235. With regards to termination of employment due to redundancy, what does the law state regarding SIL’s earned?

    Should all unused SIL’s be converted into cash and paid out to employees even if they will already be getting redundancy pay (one month salary for every year of service)?

    Or does the company have the option of not paying out the unused SILs of employees? Is it legal that they will only pay the SILs earned for the current year, and forfeit the remaining unused leaves?

    Does SIL refer only to vacation leaves or can it include sick leaves?

    I reviewed my employment contract, there is a “Retirement Pay” mentioned. It is equivalent to one-half month salary for every years of service. As our company will end our employment, not sure if I am qualified already for the Retirement Pay since I am only 25 years old.

    “Now, what if the employee has served for less than 6 months, how much separation pay will he get? Let’s see.
    one month salary = P8,000; or
    1/2 month salary for every year of service = (1/2) x P8,000 x 0 year = 0.
    So, it’s still P8,000 or one month salary.”
